US permits Russian diesel transactions under a temporary sanctions exemption

Where it stands

The United States has authorised specified transactions involving Russian diesel through 7 April 2027. The Treasury issued the permission on 9 October after President Donald Trump announced a diesel arrangement following talks with Vladimir Putin. The legal change covers the sale, delivery, unloading and import of diesel, including into the United States. Previously, transactions prohibited by the covered Russia-related sanctions could not proceed without authorisation. The new general licence creates an exception for diesel transactions within its terms. This can remove a legal obstacle for participating traders, shipping firms and financial intermediaries. It is not a lifting of every sanction on Russia. The permission does not automatically extend to crude oil, petrol or every payment involving Russian institutions. It expressly excludes debits to certain Russian state accounts at US financial institutions. The distinction matters for India too. The diesel permission does not itself withdraw separate tariffs or exempt every Indian purchase of Russian energy. Nor does permission establish that promised supplies have already arrived or that retail fuel prices will fall.

Background

Diesel is a refined fuel, produced by processing crude oil in a refinery. A country may export crude, refined products, or both. Rules concerning one product therefore cannot safely be treated as rules for the entire oil trade. Sanctions restrict specified transactions, assets or dealings with designated parties. A shipment involves more than a buyer and seller: banks may process payment, insurers cover risks and vessels carry the cargo. A restriction affecting one of these steps can prevent a transaction from going ahead. A general licence permits a defined category of transactions that the sanctions would otherwise prohibit. Businesses can rely on that permission only when the transaction satisfies its scope and conditions. The underlying sanctions framework remains in place outside the exception. The Treasury's new licence covers diesel transactions under two US Russia-related sanctions frameworks. It does not rewrite other countries' laws or authorise activity outside its own terms. Companies still need to check the product, parties, payment route and applicable restrictions. Even where the legal route opens, physical supply is a separate question. Refineries must produce the fuel, traders must arrange purchases and vessels must deliver it. The price ultimately paid also depends on market conditions and transport costs. A sanctions exemption should therefore not be reported as an immediate price reduction for consumers.

    The licence authorises covered diesel sales, deliveries, unloading and imports until 12:01 am US Eastern Daylight Time on 7 April 2027. That is 9:31 am IST on the same date. It covers transactions otherwise prohibited under the two Russia-related regulations named in the document. However, it does not authorise debiting accounts held at US financial institutions by three Russian state bodies. These are Russia's central bank, National Wealth Fund and Ministry of Finance. The specific restriction remains relevant even when the goods being traded are diesel. Trump has announced additional Russian supplies, but an announced arrangement is not evidence of completed deliveries. The licence establishes what is legally permitted within its scope; subsequent trade data would show what actually moves.

Tariff and sanctions exemptionA tariff is a customs duty on imports. A sanctions exemption permits defined activity despite an otherwise applicable sanctions restriction. Changing one does not automatically remove the other, which is why this diesel permission cannot be read as a blanket tariff waiver.
