National Chambal Sanctuary: Sand Mining & Supreme Court Order

Why in news?

The Supreme Court examined illegal sand mining around the National Chambal Sanctuary. Authorities had identified 551 facilitators in Madhya Pradesh's Morena district. The Court suggested preventive detention against selected facilitators. It also demanded stronger enforcement and staff protection.

Background

The Chambal River rises near Janapav and flows through Madhya Pradesh's deeply eroded ravines.

The river belongs to the Ganga system and later meets the Yamuna in Uttar Pradesh.

Madhya Pradesh protected its stretch in 1978, followed by Rajasthan and Uttar Pradesh.

Together, these notifications created a long tri-state river sanctuary covering about 5,400 square kilometres.

The corridor follows roughly 600 kilometres from Jawahar Sagar towards the Panchanda confluence.

Why was the sanctuary created?

The sanctuary mainly protects river habitat for the gharial, a fish-eating crocodilian.

The International Union for Conservation of Nature classifies Gavialis gangeticus as Critically Endangered.

The sanctuary holds the world's largest wild gharial population and remains its most important refuge.

The river also supports the Endangered Ganges river dolphin, Platanista gangetica.

Another important species is the Critically Endangered red-crowned roofed turtle, Batagur kachuga.

Why are sandbanks essential?

Gharials use open sandbanks for basking and nesting, while female turtles bury eggs there.

Seasonal flows reshape this habitat, but mining removes sand faster than nature replaces it.

Machinery can destroy nests, disturb breeders, alter channels and increase water turbidity.

These changes affect fish, turtles, crocodilians and dolphins together.

What case is the Supreme Court hearing?

The Court took up the issue on its own motion, called a suo motu proceeding.

The case concerns illegal sand mining and threats to endangered aquatic wildlife.

Justices Vikram Nath and Sandeep Mehta heard the matter on 22 July 2026.

The bench was told that Morena authorities had identified 551 mining facilitators.

The judges asked about preventive detention for selected offenders, considering it a possible deterrent.

Legal caution: The Court made an observation during the hearing. It did not order automatic detention of all 551 persons.

What is preventive detention?

Ordinary criminal punishment follows conviction for a past offence. Preventive detention seeks to stop anticipated harmful activity.

It is an exceptional legal power because detention occurs without an ordinary criminal trial.

Article 22 of the Constitution provides safeguards and special rules for such detention.

Authorities must act under an applicable law. They must also follow procedural limits and review requirements.

What earlier directions did the Court give?

  • States must strengthen vacant frontline forest and enforcement positions.
  • Officials must coordinate action against illegal vehicles, machinery and transport.
  • Prosecution should cover owners, financiers, operators and contractors, not only drivers.
  • States should consider lawful seizure, confiscation and preventive detention measures.
  • A structured welfare programme should protect forest guards and their families.

The Court was told that some guards had faced violent attacks. Death compensation had reportedly risen from ₹10 lakh to ₹25 lakh.

The next hearing was fixed for 11 August 2026.

Why is enforcement difficult?

The sanctuary crosses three states and many administrative boundaries. Illegal networks can shift mining or transport between districts.

Demand for construction sand creates high profits. Frontline staff may face organised resistance and personal danger.

Effective protection therefore needs shared intelligence, equipment and prosecution. River monitoring must also continue beyond short enforcement drives.

Conclusion

Protecting Chambal requires stopping organised mining networks while preserving natural flows and essential sandbank habitats.
