Where it stands

On 31 August 2026 the Court of Arbitration at The Hague ruled on the Indus Waters Treaty. The Court said India's abeyance of the treaty is not permissible. The Court said the treaty remains fully in force. The Court also barred India from concreting the Ratle dam wall and power intake above set levels. The bar lasts until 90 days after the Neutral Expert's final decision, expected in July 2027. India rejected the award the same day. India says the Court is illegally constituted. India says the treaty stays in abeyance. Pakistan welcomed the award. No formal mechanism exists to enforce the award. India has taken part in the separate Neutral Expert process.

Background

India and Pakistan signed the Indus Waters Treaty in 1960 with the World Bank. The treaty gives the eastern rivers Ravi, Beas and Sutlej to India. The Western Rivers, Indus, Jhelum and Chenab, go to Pakistan. India may build hydro projects on the Western Rivers under the treaty's design rules. Pakistan objects to the design of India's Kishenganga and Ratle projects. India asked the World Bank for a Neutral Expert. Pakistan asked for a Court of Arbitration. The World Bank appointed both in October 2022. India joined the Neutral Expert process. India says the treaty allows no parallel processes.

    India puts the Indus Waters Treaty in abeyance after the Pahalgam attack

    On 22 April 2025 terrorists killed 26 people at Pahalgam in Jammu and Kashmir. On 23 April 2025 India's Cabinet Committee on Security put the treaty in abeyance with immediate effect. India rejected the Court of Arbitration's later awards of 27 June 2025, 8 August 2025 and 15 May 2026. On 4 March 2026 Pakistan asked the Court to rule on the treaty's status. The Court heard Pakistan from 26 to 28 April 2026, with no response from India.

    The Court says the treaty remains in force and orders limits on Ratle

    On 31 August 2026 the Court of Arbitration ruled unanimously on India's abeyance of the treaty. The Court called the abeyance "not permissible under the treaty or other applicable rules of international law". The Court said the treaty remains fully in force. India must observe the treaty, including its design rules for hydro projects on the Western Rivers. The Court also barred India from concreting the Ratle dam wall and power intake above set levels. The bar lasts until 90 days after the Neutral Expert's final decision, expected in July 2027.

    Official response

    India rejects the award and says the Court has no legal standing

    On 31 August 2026 India's Ministry of External Affairs rejected the award. The ministry called the Court an "illegally constituted so-called Court of Arbitration". The ministry said the World Bank set up the Court "in patent breach of the terms of the Treaty". The ministry said India has never appeared before the Court. The ministry said the Court's pronouncements "will have no effect on India's actions" on India's projects. The ministry said India's decision to hold the treaty in abeyance remains in force.
